Legal Directorate

  1. provides the legal and regulatory terms of the Minister’s activities;
  2. prepares and participates in the drafting of regulations in the field of transport, information technology, communications and e-government;
  3. provides opinions on the implementation of laws and regulations;
  4. ensures the legitimacy of individual administrative acts of the Minister;
  5. prepares drafts of orders, decisions and protocol rulings of the Council of Ministers related to the activity of the Ministry;
  6. ensures the legitimacy of the Ministerial procedures in accordance with the applicable law;
  7. participates, together with its representatives in working groups to develop draft regulations related to transport, information technology, communications and e-government, and interacts with other ministries and departments on the harmonization of legislation with EU law;
  8. provides legal assistance and support to the administration of the Minister and the Political cabinet;
  9. participates, together with its representatives in international groups in the field of transport, information technology, communications and e-governance, giving opinions regarding the correlation between international and national law;
  10. performs procedural representation of the Minister and the Ministry in the judicial, arbitral or administrative bodies;
  11. ensures the legitimacy of acts of the Minister in his capacity as an authority exercising the rights of the state in the capital of commercial companies with state participation in the capital and state-owned enterprises in the system of Transport, Information Technology and Communications, and the legitimacy of acts of the Minister as the authority which carries out preparatory actions and submits proposals for granting concessions for state-owned facilities;
  12. prepares statements on Constitutional cases in which the interested party is the Minister;
  13. prepares statements on drafts of international contracts;
  14. agrees on the legitimacy or gives statements on the legitimacy of civil and labor contracts concluded at the Ministry;
  15. provides legal assistance to the Minister in exercising his powers in relation to the activities of the second level spending units;
  16. ensures, in legal terms, the activity assigning in the public procurement;
  17. participates in tenders and in the preparation of contracts under the ISPA program and the other international financial institutions and performs the legal provision of the activities related to the financial assistance from the European Union.
